Expediting Your Case

It is an unfortunate reality that nearly two-thirds of all initial Social Security disability applications are denied, and that more than four out of every five claims are also denied at the reconsideration stage. It is very important that denials be appealed timely. Also, it is very important not to lose hope during what can be a long process. From the initial application to a hearing before an administrative law judge can often take 18 months.

At our office, we know from experience that there are seldom ways to make government agencies and employees process your claim any faster. We do know, however, that you can cut down on the time it will take to get benefits by submitting complete information and responding to requests in a timely fashion. Sometimes having an attorney help, even at the earlier stages, can facilitate the expedited handling of your case.

In cases where the evidence of disability is so strong that it appears that an Administrative Law Judge could make a fully favorable decision without any testimony or other additional evidence, we may ask the ALJ to make a favorable "On the Record" (OTR) decision before a hearing is scheduled. We will carefully review your case to determine whether yours is a good case for an OTR request. If our request is granted, you will receive a decision much more quickly and avoid the stress and hassle of attending an administrative hearing.

There are also certain hardship conditions, including current or pending homelessness, which can support a request that a hearing be expedited. Our attorneys will be sure to explore any options that might result in an earlier resolution of your case.
